The legal issues analyzed in this study are the construction of criminal law on cyber crime which includes the act of reporting hoax and hate speech through social media. This research is a normative doctrinal or juridical research using a statute approach and an analytical approach. The results of this study indicate that the construction of criminal law on cyber crime includes the act of reporting false news and hate speech through social media. At the level of legislation, Indonesia actually has a number of pieces of legislation that prohibits anyone from spreading hate speech in public spaces. However, the construction of the rule of law seems not only inadequate, but is also widely considered problematic so that its implementation has the potential to threaten freedom of expression.
